Outlines of the case:
Between the 11 and the 26 of August of 2009, Rubén González, with 2000 workers of Ferromineria(mining company union) Orinoco, started a strike for the in-completion of the collective convention signed the 5th of January of 2009, and approved the 1st of January of the same year. A month later Ruben got detained and imputed for the supposed crimes of insisting crime, restriction of freedom to work, and breach of security zones. Ruben was under house arrest until the 21 of January of 2010, date in which he was finally sent to the jail police of the Caroni county, of Bolivar state.
Therefore, the 28th of February of 2001 was convicted to 7 years and 6 months of jail, which generated the movement and rejection of different syndicates and human rights organization in the country, achieving the nullity of trial, but no the law of the cause, for whom Ruben Gonzales had been liable to present himself regular y before the Tribunals, waiting the new trial to start against him. the open trial was due to start last 20/02/13 at 9.30pm but this one was postponed for the next 10th of April of 2013, so the Tribunal 24 of the Penal Judicial circuit of the Judicial circumscription of the metropolitan area of Caracas, begins the process.
Rubén González case is one of the most enigmatic reflection of the Venezuelan state politics to criminalize protest and threaten against syndicate freedom. Same as him, more than 1200 syndicalist leaders are finding themselves threaten and called into trial by the tribunes, for the mare fact of exercising the free right to protest, consecrated by the National Constitution.
Rubén González trial, is an assignation of primary order for the syndicalist organizations and of human rights defense. syndicalist freedom and the right to a pacific protest, without risks of incrimination and persecution on the behalf of government institutions, are indispensable complements for our construction of a real participation and leading democracy for the effective materialization of this "social state of right and justice" that our Carta Magna expresses.
